1. Acceptance

By signing up for or using Tube Optimizer (“the Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. The Service is provided by Digiboffins and is intended for creators who want to optimize and manage their YouTube content.

2. Use of the Service

You may use the Service only in compliance with these Terms and all applicable laws. You must have the right to link your Google/YouTube account and to authorize us to access and modify your channel and video data as you direct (e.g. publishing, updating metadata, moderating comments). You are responsible for keeping your account credentials secure and for all activity under your account.

3. YouTube and Google policies

Use of YouTube and Google features through the Service is subject to Google’s Terms of Service, the YouTube Terms of Service, and the Google API Services User Data Policy. You must comply with YouTube’s Community Guidelines and other policies. We are not responsible for Google’s or YouTube’s actions, availability, or policy changes. Revoking our access in your Google account will limit or disable related features in the Service.

4. Content and conduct

You retain ownership of your content. By using the Service, you grant us the rights necessary to operate the Service (e.g. storing projects, calling YouTube APIs, displaying content to you and to users you invite). You must not use the Service to upload, publish, or promote content that is illegal, infringing, misleading, or that violates YouTube’s or any other applicable policies. We may suspend or terminate access if we reasonably believe you have violated these Terms or abused the Service.

5. AI-generated content

The Service uses AI to generate suggestions (e.g. titles, descriptions, tags). Such output is for assistance only; you are responsible for reviewing and approving any content before it is published to YouTube. We do not guarantee accuracy, suitability, or compliance with YouTube’s policies. You use AI-generated content at your own risk.

6. Availability and modifications

We strive to keep the Service available but do not guarantee uninterrupted access. We may change, suspend, or discontinue features with reasonable notice where practicable. We may update these Terms; the “Last updated” date will change, and continued use after changes constitutes acceptance.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE ERROR-FREE, OR THAT YOUTUBE OR GOOGLE APIS WILL ALWAYS BE AVAILABLE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGIBOFFINS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE OR INABILITY TO USE IT. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ONE HUNDRED US DOLLARS IF GREATER).

9. Termination

You may stop using the Service at any time. We may suspend or terminate your account and access if you breach these Terms or for other legitimate reasons. Upon termination, your right to use the Service ends. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, dispute resolution) will survive.
